Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Perfetta website, waitlist, and the Perfetta mobile application (collectively, the "Service"), operated by Perfetta ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Perfetta provides camera guidance features, including sunlight positioning guidance and framing assistance ("BF Mode"), designed to help you take photos. The Service is provided for personal, non-commercial use only. Features shown on this website, including videos, animations, and demonstrations, are illustrative previews and may differ from the final product. We may add, change, suspend, or discontinue any feature at any time, with or without notice.

2. No professional or safety advice

The Service provides aesthetic suggestions only. It does not provide professional photography, medical, or safety advice. You are solely responsible for your surroundings and personal safety while using the Service, including while looking at your screen or moving to follow on-screen guidance. Never use the Service while driving or in any situation requiring your full attention.

3. Intellectual property

The Service, including its design, software, text, graphics, logos, the Perfetta name and marks, and the sunlight-guidance mechanism (patent pending), is owned by or licensed to us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purpose. You may not copy, modify, reverse engineer, decompile, scrape, resell, or create derivative works from any part of the Service, or use our name, marks, or content without our prior written consent.

4. Your content

Photos you take or upload remain yours. Because photos and camera data are processed on your device, we do not access, store, or claim any rights over your photos. If you choose to send us content (for example, feedback or support messages), you grant us a non-exclusive, worldwide, royalty-free license to use that content to operate and improve the Service.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access it in an unauthorized way, interfering with its operation, reverse engineering its guidance methods, using it to violate any law or the rights of others, or photographing people in violation of applicable law. We may suspend or terminate access for any violation of these Terms.

6. Waitlist and communications

Joining the waitlist does not guarantee access to the app, a TestFlight invitation, or any particular launch date. Invitations are sent at our sole discretion.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PHOTOGRAPH TAKEN USING THE SERVICE WILL MEET YOUR EXPECTATIONS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Perfetta and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or any law or third-party right.

10. Dispute resolution and governing law

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and you waive any right to a jury trial or to participate in a class action or class-wide arbitration. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provision. If arbitration is found unenforceable, disputes will be brought exclusively in the state or federal courts located in Delaware.

11. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted on this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver.

Privacy Policy

Perfetta processes your camera, motion, and location data on your device to guide you into better light. Your photos, your location, and your camera feed never leave your phone. We do not create accounts and we do not track you across other apps or websites.

Data you choose to share

When you opt in to help improve Perfetta, each photo can contribute anonymous lighting measurements that help refine the sunlight guidance. The app sends angles and brightness numbers to our servers—not your photographs, camera feed, or GPS coordinates. Sharing is your choice. You can turn this off or request deletion of this data at any time in Settings or by emailing us.

Waitlist email

If you join the TestFlight waitlist on this site, we store your email address only to send you the invite and related product updates. We do not sell or share your email with third parties for their marketing. Email hello@thedatasnap.com to be removed at any time.

Data security and retention

This website uses essential browser storage for site functionality and to remember your cookie preference. We do not currently use optional analytics or advertising cookies. Accepting all cookies does not enable additional tracking. You can change your preference using the cookie settings button.

We retain waitlist emails until you unsubscribe or ask us to delete them, and anonymous lighting measurements only as long as needed to improve the Service. We use reasonable technical and organizational measures to protect the limited data we hold, but no method of transmission or storage is completely secure.

Children

The Service is not directed at children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

Your rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal data, or to object to or restrict its processing. To exercise any of these rights, email hello@thedatasnap.com. We will respond within a reasonable time.

Changes to this policy

We may update this Privacy Policy from time to time. Changes take effect when posted on this page, and the "Last updated" date above will be revised.
